Why Remarriage Often Affects Alimony

Tracy Roberts

After you have filed for divorce, you may wish to get remarried, and you might think nothing of it. However, you, then, receive a spousal support payment from your ex, you may wonder if your remarriage will affect the spousal support arrangement. This is something you will always want to bring up with your family lawyer.

Situations Where Remarriage Might Affect Alimony

When the courts establish an alimony agreement, your settlement agreement might have specific terms that address what will happen if you remarry. You may no longer be entitled to receive spousal support. Also, whether or not your spousal support will be affected by the laws of your state.

Marriage or even cohabitation can end alimony in some states. In other states, you will need to specifically get married to stop receiving alimony payments, while in other states, a remarriage will not affect your alimony at all unless the terms of your settlement specifically address this.

Types of Alimony

The reason why you are receiving alimony can affect whether you will continue to receive alimony after you have filed for divorce. For example, with rehabilitative divorce, you will only receive spousal support until you have gotten back on your feet. The courts will determine whether you no longer need alimony. If you remarried, your financial situation might change due to the income and assets of your new spouse. As a result, you may not be eligible for spousal support.

Temporary alimony is likely not to be a factor because you will only receive temporary alimony until you are fully divorced. Since you cannot remarry if you not yet divorced, this form of alimony cannot be affected by remarriage.

Don't Assume That "Permanent" Alimony is Permanent

Though it is listed as permanent, this form of alimony often has an end date and might also end when certain conditions are met. If there is no specific date when permanent alimony will end, the date at which it will end is based on your state laws. Therefore, you will want to speak with an attorney who is licensed to practice in the state where you get divorced.

If your alimony has not officially ended, your partner might continue to pay alimony even if you remarry because the spouse may be required to go to court to request that the alimony agreement be terminated. If this happens, it's best to consult with a divorce lawyer on how best to proceed.
