When you file a personal injury claim, there are typically two ways in which you can receive compensation. You can either receive an injury judgment or an injury settlement. These two different methods of compensation are different and can have vastly different outcomes when it comes to the sum of money you receive. What Is an Injury Settlement?

When you decide on a settlement for your personal injury claim, you first have to understand how the claims process works. When you are first injured, you have to file a claim with the insurance carrier of the party who you believe to be negligent and liable for your injury. At that point, you will work with a personal injury lawyer to collect evidence to support your claim.

After you submit your evidence to the insurance carrier of the liable party, you will then wait to hear if the carrier will pay you for your damages.

However, this process is not cut and dry. You may receive a settlement offer right away with an acceptable settlement offer. However, you may receive a settlement that is below what you want, or you may not receive a settlement offer at all if the insurance carrier does not believe its insured party caused your injury.

The goal of a settlement is to handle the entire process out of court. If you receive a settlement offer that you are not happy with, you can opt to negotiate with the insurance carrier, go through mediation to work out a better deal, or enter binding arbitration. These are all legal procedures but are handled by legal professionals other than a judge.

An injury judgment occurs when you go to court to have a judge and possibly a jury help determine the outcome of your personal injury claim. If you were not able to reach what you deem to be a fair decision during the settlement process, the pursuit of an injury judgment is your next step.

You can go to small claims court for an injury judgment if the amount you want is small. You will have to look at the limits for your state. For other judgments, you have to go through the civil court. The judge will hear the case from both attorneys and make a legally binding decision.
