The Workers' Compensation Check-Up: What To Know

After a work-related injury or occupational illness, it's good to know that you have insurance coverage. Workers' compensation insurance costs employees nothing and pays medical expenses and a partial disability wage. The Independent Medical Exam

You have been under the care of a doctor since your injury. Since workers' compensation is a state program, the rules about what kind of doctor hurt workers may use vary. In some cases, they must use a specific doctor chosen for the job. In other cases, they can use whatever doctor they wish. When it's time for the independent medical exam (IME) however, they must be seen by a specific new doctor of the workers' comp choosing.

What is the Purpose of the IME?

Everyone heals from injuries at different rates. In some instances, a hurt worker has such a severe injury that the effects will permanently affect their ability to work at their job. In other cases, the insurance carrier wants to get a better idea of when they can expect a hurt worker to return to their job. This exam allows an examination of the worker with an emphasis on their injury.

Maximum Medical Improvement

The above term describes a hurt worker that has reached a plateau in healing. They have reached a point where no further improvement is expected and this can often mean a permanent injury. There are other results of the IME, however. If you are making progress but still need more time, your temporary benefits will continue for a time. In this case, another IME may be planned for the near future.

If you are determined to be healed enough to return to your job, you will be released from workers' compensation care and you must return to your job. Unfortunately, cleared workers are not always ready to resume their duties and this can set up a situation in which you are in danger of losing your job if you don't return. If you have been asked to return to work but are not ready, you will need to speak to a workers' comp lawyer. You have a right to have a second IME performed.
