For the parents of a minor child, deciding on custody matters can be among the most difficult parts of a divorce. Most parents want to protect their children from the negative effects of divorce, and the family court system does as well. No one really can know what is best for children better than the parents, and coming together for a common cause is so important. Taking this issue to court can only lead to stress, expense, and the loss of time, but that is what will happen if you two cannot make a decision concerning custody.
If you and your spouse are completely at odds on this issue, the family court judge may order you all to undergo a child custody study. This is an evaluation of you as parents, and it determines who should be awarded custody; sole physical custody, that is.
Another Choice
It doesn't have to be that way, though; if you and your spouse are both interested in being the custodian of your child you might be good candidates for shared custody. Agreeing to go this route outside of court will eliminate the need for a costly study and allow you to smoothly transition into a custody arrangement.
What is Shared Custody?
As this form of custody is also know as 50/50 you can probably envision how it works. It's important to understand, however, that when you are dealing with real life it may be difficult to make that custody percentage come out perfectly even. The idea is for both parents to spend roughly 50% of the time with the child, but the actual plan for doing that is somewhat flexible and left up to the parents.
Is Shared Custody Right for Your Family?
This type of custody is slightly more difficult to manage, but may be well worth if it means the child is able to spend time with both parents. Here are some situations that feed this custody model:
1. The parents live close to each other. Since the child will be going back and forth, the closer the better.
2. The parents get along with each other. Cooperation and communication are paramount when it comes to coordinating the schedules, so the parents need to be friendly to make it work well.
3. The parents are extremely organized. The older and more active the child, the greater the need to use shared calendars and be flexible with time.
The best thing about shared custody is that it tends to lessen the disruption in the child's life; neither parent has to be missing for a greater amount of time as it would be with joint custody.
