3 Things You Should Do Before You File A Medical Malpractice Lawsuit

If you have been wronged by someone in the medical field, you might be wondering if there is anything that you can do make things right. In many cases, you can file a medical malpractice lawsuit that will help to recoup any pain, suffering, and losses that you experienced because of the medical procedure. If you are considering filing a lawsuit, here are some things you should do first.

1. File A Claim and Grievance Against The Hospital or Doctor

In many cases, you can avoid filing a personal injury lawsuit by going through the hospital and reporting a grievance and an insurance claim. For instance, you might have gone in for a routine procedure, and in the process the doctor accidentally harmed a nearby organ, making it so that you needed an additional surgery. In this case, you could demand that the hospital not charge you for the additional surgery and cover all of the expenses of the hospital stay. If there was pain and suffering after the accident, such as a longer recovery, the inability to go back to work and so forth, you should include those costs in the demand. The hospital may be more than willing to work with you, and this will avoid having to file a lawsuit.

2. Get A Second Opinion

Having a second opinion will strengthen your claim and your lawsuit if applicable. You need to have another doctor, in the same field, let you know what they would have done in your situation and if the other doctor followed protocol and acted rationally. If the second opinion confirms that the other doctor did everything right, then you may not have grounds for a lawsuit. However, if it is determined that the other doctor did in fact make a mistake, then you can use this second opinion as leverage to get what you need.

3. Have The Attorney Write A Demand Letter

Before you file a full-blown lawsuit, you can have the attorney write a demand letter. This letter will go to the hospital letting them know that if your demands are not reasonably met then you will be filing a lawsuit. This gives the hospital and doctor a chance to avoid all of the legal fees of the suit and make things right. If they still don't comply, then you will have to actually file the suit.
