The first legal route you can consider is suing for money damages. This route requires you to file a lawsuit in a small claims court.

Legal Route Two: Cease and Desist

The second legal option is getting a judge to give a cease and desist order to your neighbors forcing them to stop making so much noise. This option is ideal if you aren't looking to get any money and you really just want your neighbors to stop making so much noise. This route will require you to file a lawsuit through civil court instead of small claims court.

Regardless of which route you choose to take the end goal is to get your neighbors to stop being so noisy. It is a common misconception that the cease and desist order from the judge is the best option to get the noise to stop. However, a money judgment through a small claims court can be just as effective. In order to understand this, it can help to look at it from the point of view of your neighbor. Would you continue to make tons of noise if you knew your neighbor could sue you for monetary damages for doing so?

How Do You Win The Lawsuit?

In order to win your claim, you will have to prove the neighbor was making an excessive amount of noise. This requires evidence such as written statements asking your neighbor to quit making so much noise or police reports for noise disturbances. It can also be helpful to talk to people living in the other houses in the neighborhood to see if they agree that your neighbors make an excessive amount of noise. The other people in the neighborhood can be witnesses to support your case. You could even invest in a security camera and record the noise your neighbors are making.

In most states, you can ask for between $2,500 and $7,500 in small claims court. Consider asking for a small amount such as $20 or $30 for every day the noise disturbed you. If the noise was severe and it was impeding your ability to sleep or work (if you happen to work from home), you could easily ask for a higher amount of money per day without it being unreasonable.
