3 Ways You Can Help Your Personal Injury Case

Car accidents are never fun. If you sustain injuries from the accident, and you feel someone else is responsible for those injuries, you will likely want to file a personal injury case. Many people file personal injury cases every year - some win, but some lose. Here are three ways you can help your personal injury case.

1. Disclose any prior injuries or medical conditions.

One of the most important things you need to do when filing a personal injury lawsuit is disclose any prior injuries or medical conditions you had that were worsened by the accident. You should not, under any circumstances, try to pass off any preexisting condition as something new that was caused by the accident. Instead, have your doctor prepare a statement of how the accident worsened your injury or medical condition.

Full disclosure will help your case if the defense tries to get out of payment because of those preexisting medical conditions because you are not claiming the accident caused the injuries--instead, you are saying they were worsened by the accident.

2. Seek immediate medical treatment and follow doctor's orders.

No one likes to go to the hospital for treatment. However, it is usually necessary following an accident. Of course, you can refuse medical treatment, but that will not help your personal injury case. If you feel your injuries don't warrant a trip to the emergency room, then you need to at least go see your doctor as soon as you can get an appointment. Go to an urgent care clinic for treatment if your doctor isn't available within 48 hours.

If you fail to seek adequate medical treatment following an accident--or you don't follow doctor's orders for your treatment--then the defense can claim you failed to mitigate damages. You can't willingly worsen your health and then expect the defendant to have to pay for your medical treatment. So, if you want to ensure your personal injury case doesn't get shot down for your failure to mitigate damages, see a doctor after the accident and follow their treatment plan.

3. Write down as much as you can remember immediately following the accident.

Your attorney's ability to win your personal injury case is partially dependent on getting an accurate account of the accident from you. So, as soon as you are able to sit down and think after the accident, you should sit down and write everything down that you can remember. If you aren't able to write due to your injuries, then ask someone if you can dictate your account to them to write down. The important thing is not to leave out anything you think might harm your case. Every detail is important, and being honest is the best way to try to win your case.
